This Auction Carries an 8.7% Buyer's Premium. If paid by check or wire transfer a 3% discount applies to the buyers premium. Payment information and wire information will be sent with your invoice. There will be no adjustments to the final bid price after the bidding closes.

*All Items are being offered AS-IS. It is buyer’s responsibility to inspect equipment. No refunds will be made for any reason. It is the responsibility of the buyer to assess equipment condition and specifications to their satisfaction prior to bidding.

*Descriptions have been obtained from sources believed to be reliable, however prospective buyers are strongly encouraged to inspect the property. Seller does not guarantee accuracy of descriptions.

*All Buyers must make payment no later than 12:00 Noon, December 10, 2009.
Acceptable methods of payment include Certified Check, Company Check with “Bank Letter of Guarantee”, Wire Transfer; and the following Credit Cards: Visa™, Mastercard™ and Discover Card™. Payment Information and Wire Information will be sent with your invoice. Wire Transfers initiated from banks outside of the United States are subject to a $35 charge.
All payments must be sent to the address provided on your invoice

*Buyer Must Arrange for Loading.
*Buyer’s who fail to complete their purchase may be precluded from participating in future sales.

*Items not picked up by December 17, 2009 2:00 p.m. will be considered abandoned. Abandoned items will be subject to a $50 per lot/per day storage fee and storage fees not paid or items not removed within 7 days past removal deadline results in forfeiture of the item to the seller without refund.

*Buyers are strictly forbidden to send any third party customers onto property for the sole purpose of inspection of equipment for possible resale.

Auctioneers Note:
Both Asset Auctions and the Seller want all of our buyers to feel they have been treated fairly and pay a fair price for the items based on their condition. Please do not enter a bid at a price that is greater than you are comfortable paying for any individual item based on it's condition. There will be no adjustments to the final bid price after the bidding closes.

All items are being sold AS-IS. Any notes or descriptions are for information only, you need to make your own decisions based on your own observations. Items often sell at very reasonable prices but sometimes need minor to major mechanical and/or cosmetic work. If you are wanting to have a high level of confidence you MUST inspect for yourself and make decisions based on this inspection. We strongly urge you to inspect on the preassigned inspection dates that will be posted on our website. There will be no adjustments to the final bid price should you find any problems with the item after the bidding closes.

Insurance Requirements:
Buyers are required to comply with any safety or removal requirements sent forth by the seller.

Asset Removal:
Buyer is required to remove all items in the lots purchased. All removal shall be at the expense, liability and risk of the Buyer. If the Buyer does not remove an item within the stated removal period, Asset Auctions and the Seller may, at their sole discretion, deem the Asset to have been abandoned by the Buyer and the Buyer will have no further rights with respect to the Asset. In most cases Buyers, outside contractors, including riggers and machinery movers, will not be allowed to work on the Seller's premises until they have provided proper insurance, protecting Asset Auctions, the Seller and the landlord from all and any claims resulting from their actions.

Terms and Conditions:

1. All sales are Final.
2. Each item is sold AS/IS, WHERE-IS, with no warranties or guarantees expressed or implied.
3. Buyer must contact the ODOT employee listed on the description/location and make an appointment for pick-up. All vehicles must be picked up within ten (10) calendar days of purchase.
4. Once payment for item is received, a Bill of Sale will be sent to the Buyer. Once all vehicle/equipment are physically removed from ODOT property, ODOT will mail the title to the Buyer.
5. Buyer must show positive identification at time of pick-up to ODOT. Should the Buyer use a third party to remove the purchased item, the Buyer must insure that the third party has a copy of the Bill of Sale and written authorization from the Buyer to remove the purchased item.
6. Buyer must furnish the labor and equipment to remove the auction item.
7. If the Buyer fails to meet the deadline to remove the purchased item, the State may move the item to another location and the Bidder will be responsible for the cost incurred to dismantle, transport and store the item. In such an event, the State shall not be responsible for any damage by such removal and, if the Bidder has not made arrangements to pick up the items within thirty (30 calendar days, the Bidder shall be deemed to have ceded ownership to the State. thereafter, the State may dispose of the item as the State deems reasonable and retain any proceeds there from.
8. ODOT will use Buyers name and address on the Bill of Sale. The only exception to this will be if the Buyer is buying on behalf of a company/business and will need the title made out to the name of that company/business. In this case, the company/business should be listed along with the buyer name on the information provided on the Bill of Sale. The only other exception is when the Buyer wishes the address listed different on the title, or if the Buyer name requires a suffix (Jr., Sr., etc.). A different name will not be put on the title. ODOT must be notified in writing of any requesed changes within two days of payment. This should be sent to auctionsoem@dot.state.oh.us. If this information is not received by ODOT within the two day period, ODOT will use the name and address listed on the Bill of Sale for the title. ODOT will not pay for duplicate titles due to non compliance with the above.
9. Unless other arrangement have been agreed upon between the Buyer and the State, if the Buyer fails to meet the deadline to remove the purchased lot, the lot will be considered abandoned and the Buyer shall deemed to have ceded ownership to the State allowing the State to dispose of the lot and retain any proceeds from said disposal.
10. ODOT will use Buyers name and address on the Bill of Sale – except in instances when the Buyer is purchasing on behalf of a company/business and will need the Bill of Sale made out to the name of that company/business. In this case, the company/business should be listed along with the buyer name on the information provided on the Bill of Sale.
